1. Acceptance of Terms
By accessing or using the calculator, website, services, digital tools, documents, or communications, users agree to these Terms. Users who do not agree should not use the platform or services.
2. Scope of Services
ESLaunch may offer website development, local SEO-related work, Google Business Profile optimization, local trust and conversion systems, content, social media support, chatbot setup, AI receptionist setup, lead capture, lead follow-up automation, reactivation campaigns, review systems, business automation, educational products, consulting, operator programs, and related services. The exact scope, deliverables, pricing, timelines, responsibilities, third-party costs, revisions, approvals, and exclusions are determined by the applicable sales page, proposal, order form, Statement of Work, Master Services Agreement, invoice, or other written agreement. Where conflicts exist, the signed or accepted service-specific agreement controls.
3. Directional Calculator Outputs
The ESLaunch ROI Opportunity Calculator provides illustrative, directional scenario estimates based on selected inputs and industry benchmarks. Calculator outputs are not audited financial statements, forecasts, legal opinions, damage calculations, business valuations, promises, guarantees, or representations of actual or future performance. Outputs may vary materially based on factors including service mix, job type, pricing, gross margins, labor costs, material costs, overhead, demand, competition, market conditions, lead quality, response speed, follow-up, sales execution, capacity, operations, client decisions, third-party systems, and other factors beyond ESLaunch's control.
4. No Guarantees
ESLaunch does not guarantee rankings, Google Business Profile placement, search visibility, traffic, leads, calls, quote requests, appointments, booked jobs, revenue, profitability, business growth, conversion rates, client retention, sales, or any other business outcome. Any examples, estimates, projections, testimonials, model outputs, case studies, benchmark ranges, or illustrations are not guarantees of future performance.
5. Client Responsibilities
Clients are responsible for providing accurate business information; providing timely access, approvals, branding, images, business details, and materials; ensuring claims, licenses, insurance, pricing, promotions, services, and business information are accurate and lawful; reviewing deliverables and submitting feedback within agreed timelines; maintaining legal authority over their business, website, phone numbers, domains, Google Business Profile, social profiles, and customer data; paying all agreed invoices and applicable third-party costs; obtaining permissions, consents, and rights necessary for ESLaunch to perform services; and complying with applicable laws and platform policies. Delays in required client information, access, approvals, feedback, payment, third-party verification, or platform access may delay delivery.
6. Third-Party Services and Costs
Certain services may depend on third-party platforms or usage-based systems, including SMS, email, calling, AI tools, phone providers, domain providers, hosting providers, CRM systems, automation providers, scheduling platforms, analytics platforms, Google services, social platforms, and other software services. Third-party usage costs may apply where applicable and may be billed separately, passed through, invoiced, or identified in the applicable Statement of Work, Master Services Agreement, proposal, or order form. ESLaunch is not responsible for third-party outages, suspensions, pricing changes, policy changes, account restrictions, platform decisions, verification processes, technical limitations, or service interruptions.
7. Intellectual Property
ESLaunch retains ownership of its proprietary methods, templates, systems, frameworks, software, tool designs, calculator logic, workflows, processes, documentation, training materials, prompts, automation structures, brand assets, and other intellectual property unless a written agreement explicitly states otherwise. Client-owned materials remain client-owned. Licenses or rights to final client deliverables are subject to full payment and the applicable agreement.
8. Permitted Use of the Calculator
Users may use the calculator for lawful internal business-evaluation purposes. Users may not: scrape, harvest, extract, copy, reproduce, resell, rent, lease, sublicense, distribute, or commercially exploit the calculator; reverse engineer, decompile, disassemble, or attempt to discover source code, formulas, architecture, logic, or proprietary systems; use automated bots, crawlers, scripts, or tools to access or collect calculator data without written permission; remove copyright, trademarks, notices, or branding; use the calculator to create a competing product or service; misrepresent calculator outputs as audited, guaranteed, legal, financial, or verified statements; use the calculator for unlawful, deceptive, abusive, or harmful purposes; or interfere with the calculator's security, availability, or integrity.
9. Educational and Operator Products
For ESLaunch educational products, frameworks, operator programs, blueprints, training materials, consulting, or implementation guidance: ESLaunch provides information, frameworks, tools, and guidance. ESLaunch does not provide clients, guaranteed sales, guaranteed revenue, guaranteed rankings, guaranteed profitability, or guaranteed business outcomes. Outcomes depend on the purchaser's execution, sales ability, service quality, market selection, software stack, effort, fulfillment quality, consistency, and other factors.
10. Payments and Commitments
Prices, payment schedules, initial commitments, renewal terms, and specific inclusions are governed by the applicable offer, invoice, proposal, Statement of Work, Master Services Agreement, or order form. Certain done-for-you service packages may include initial commitments, including 90-day or 180-day commitments, depending on the selected package. After an initial commitment, services may continue month-to-month unless otherwise stated in writing. Setup fees are generally tied to allocation of onboarding, strategy, implementation, configuration, buildout, and launch resources.
11. Suspension or Termination
ESLaunch may suspend, limit, or terminate access to the calculator, tools, services, or communications for nonpayment, fraud, abuse, illegal activity, harassment, security risk, violation of these Terms, misuse of third-party platforms, failure to provide required information or access, or conduct that materially impairs service delivery.
12. Disclaimer of Warranties
The calculator, tools, content, digital products, and services are provided on an "as available" and "as is" basis to the maximum extent permitted by law. ESLaunch disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, completeness, and results.
13. Limitation of Liability
To the maximum extent permitted by law, ESLaunch and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from or related to the calculator, services, communications, tools, deliverables, or these Terms.
To the maximum extent permitted by law, ESLaunch's total liability for any claim relating to the applicable service or tool will not exceed the amount actually paid by the claimant to ESLaunch for the specific service giving rise to the claim during the three months immediately preceding the event giving rise to the claim.
14. Indemnification
Users agree to indemnify and hold ESLaunch harmless from third-party claims arising from user-provided content, user misuse of the calculator or services, client business claims, false, misleading, unlawful, or unlicensed business information, violations of law or third-party rights, and unauthorized use of deliverables or tools.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
16. Changes to Terms
ESLaunch may update these Terms and will post an updated effective date.
